Presumptive Right to Move In our increasingly mobile society, custodial parents frequently desire to move out of state or to a different part of the state with the children, leaving the non-custodial parent far behind.  Such moves are usually based upon the fact that the custodial parent has found a new job that requires the move or has a network of family members that he or she would like to live near. 

Based on these realities, California law provides that a parent who has primary physical custody of a child has a presumptive right to change the child’s residence . i.e.  to move away with the child, subject to the power of the court to restrain a removal that would prejudice the rights or welfare of the child. A custodial parent seeking to relocate with a child bears no burden of establishing that the move is necessary.  In fact, the non-custodial parent bears the initial burden of showing that the proposed relocation of the child’s residence would cause detriment to the child, requiring a reevaluation of the child’s custody. Procedural Safeguards.Based on our strong public policy favoring stable custody arrangements, trial courts will usually make an immediate interim ruling staying the move-away until the parents have been given the opportunity to participate in meaningful mediation, to obtain an independent custody evaluation and, ultimately, to present their positions at a meaningful hearing ?including the right to present live testimony. If the non-custodial parent makes such an initial showing that the move-away would be detrimental to the child, the court must perform the delicate and difficult task of determining whether a change in custody of the child is in the room.

I have been a  local family law lawyer, Fremont, for over 30 years.

            3.  Ask legal counsel about his staff.  Does his firm have back up attorneys that can cover all situations if there is a conflict.  The worse thing is to retain an overworked lawyer who time and time again continues your court dates because of his or her unavailability because they are over booked and/or double calendaring.  Also, ask the lawyer about his staff.How long have they been working there and is there a family law legal help on the staff?  If the attorney has long term employees, it tells you that this is probably a good business operation and people will be very experienced.Experienced staff will be very helpful as they will make less errors.  Another problem is that if a firm is not well staffed, you will inevitably end up paying attorney fees for clerical matters.I have seen plenty [many] lawyers [attorneys] who do their own clerical work and take documents to court for filing.This type of work should be taken care of by clerical staff and / or courier services with much less money than having the lawyer involved.

            4.Bring up this question: how long has this lawyer been practicing and how much of it with a focus on family law.Another question: have they dealt with over a hundred cases with similar concerns as yours.Find out if the attorney [lawyer] is often in the same courthouse as the one you will have yours.  Almost, without exception, you will always gain advantage by hiring a lawyer with extensive experience in family law and who regularly and frequently practices law in the jurisdiction where your case will be heard.   A local practitioner will be aware of not only the local rules, but also the nuances of each particular family law judge in that community.  While a new lawyer may have energy and enthusiasm, nevertheless, they will not have the tactics, strategy and timing that takes many years to develop and greatly assists the practitioner in his or her representation of the client.  At a high level, and hopefully you will obtain legal counsel of this caliber, the case will be one half tactics, timing and strategy and one half legal theory.In family law, there is much more involved than just using books to look up the law.

No Prop 8 trial streaming

The lawsuit challenging the legality of Proposition 8 – the measure which made same sex marriage illegal – has begun. It’s not just the controversial subject matter that is getting people riled up, either. The trial was set to be aired on the internet via YouTube, but the defense blocked any coverage from being released at the last minute. Attorneys for Prop 8 supporters contend their clients, who supported the measure, would be subject to harassment or other harm if their identities were disclosed. Witnesses and counselors alike should get comfy, because they aren’t going anywhere for awhile.

The plaintiffs

Opponents contend that Prop 8 violates the Constitutional rights to Due Process and Equal Protection. Two couples — Kris Perry and Sandy Stier, and Paul Katami and Jeff Zarrillo — are suing because, they say, “We and our relationships should be treated equally under the law. Our goal is to advance the cause of equality for all Americans, which is the promise that makes this nation so great.” “Prop 8 used children in their campaign; Protect the Children. … It’s so insulting … to say that my marriage to [Jeff] means a child would be harmed. You put my nieces and nephews– [chokes up] they will tell you they don’t need protection from me or Jeff,” Paul Katami said, who was been partners with Jeff Zarrillo for nine years.

The defendants

Lead counsel for the defense Prop 8, Charles Cooper, said that 14 million voters in California didn’t see it their way. According to Cooper, the “basis of marriage is procreation,” and that same sex marriage would be a case of the “de-institutionalization” of marriage . He also argues that same-sex marriage is threatening to children.

“The de-institutionalization of marriage has caused a decline of marriage. … Marriage as a pro-child social institution is weakened. We believe, evidence will show, and testimony will show that that finding of fact will follow,” said Cooper.
